WHAT DATA DO WE PROCESS AND WHY?

The personal data that FDM processes are those that you provide us when you complete an order and purchase the Products, and those that we eventually collect while you browse or use the services offered on the Site. FDM can therefore collect data about you such as, for example, personal data such as your name and surname, date of birth, shipping address and billing address, and possibly navigation data and your purchasing habits.

Your personal data is processed for the following purposes:

Who is the Data Controller?

REA MI - 2510175, Fiscal Code and VAT no. 10154120967, fully paid-up share capital €3,000 (hereinafter “FDM”), is the Data Controller, i.e. the person who decides how and why to process your personal data.

  1. WHAT PERSONAL DATA DO WE COLLECT?

The categories of personal data that FDM collects and processes when you browse or make purchases on the Site are as follows:

  1. a) we collect the personal data necessary to conclude and execute your purchase on the Site such as name and surname, date of birth, e-mail address, shipping address, billing address, telephone and payment details;
  2. b) we collect your e-mail address and telephone number when you subscribe to our newsletter service or register on the Site;

We inform you that you may receive further communications from us even after submitting your unsubscribe request, as some mailings may have already been planned. It may take some time for our systems to process your request. In relation to all the activities indicated above, we will process your personal data mainly through IT and electronic tools; the tools we use guarantee high safety standards, in full compliance with current legislation on the matter.

  1. LEGAL BASIS OF THE TREATMENT

We process your personal data only in the presence of one of the conditions provided for by current legislation, and specifically:

  1. a) for the conclusion and execution of a contract of which you are a part.

When we process your data for the conclusion of the purchase contract of which you are a part we take care to use only the minimum information necessary for the execution of the same. This basis legitimizes the processing of personal data that takes place in the following activities:
- conclusion and execution of a contract for the purchase of the Products offered on the Site;

These subjects have been designated as data processors and carry out their activity according to the instructions given by FDM and under its control.

The third parties in question belong to the following categories: bank operators, internet providers, companies specializing in IT and telematic services; couriers; companies that carry out marketing activities; companies specialized in market research and data processing.

In particular, since the Site is hosted on Shopify's servers, all data is stored on Shopify's servers and according to the security standards guaranteed by Shopify. Your data may be transmitted to the police forces and judicial and administrative authorities, in accordance with the law, for the investigation and prosecution of crimes, the prevention and protection from threats to public security, to allow FDM to ascertain, exercise or defend a right in court, as well as for other reasons related to the protection of the rights and freedoms of others.

  1. EXTRA-EU DATA TRANSFER

Some of the third parties listed in the previous paragraph "Who will process your data?" may be based in countries outside the European Union which nonetheless offer an adequate level of data protection, as established by specific decisions of the European Commission ( http://www.garanteprivacy.it/home/provvedimenti-normativa/normativa/normativa -community-and-international/transfer-of-data-to-third-countries#1 ).
The transfer of your personal data to countries that do not belong to the European Union and which do not ensure adequate levels of protection will be carried out only after the conclusion between FDM and said subjects of specific agreements, containing safeguard clauses and appropriate guarantees for the protection of your data so-called "standard contractual clauses", also approved by the European Commission, or if the transfer is necessary for the conclusion and execution of a contract between you and FDM or for the management of your requests.

  1. HOW LONG DO WE KEEP THE DATA?

We keep your personal data for a limited period of time, which varies depending on the type of activity that involves the processing of your personal data.

Once this period has expired, your data will be definitively deleted or in any case made anonymous in an irreversible way.

Your personal data is stored in compliance with the terms and criteria specified below:
a) data collected to conclude and execute purchase contracts on the Site: up to the conclusion of the administrative-accounting formalities. The billing data will be kept for ten years from the billing date;

  1. b) data of the registered customer: the data will be kept until you request cancellation of your account;
  2. c) data relating to the payment: up to the certification of the payment and the conclusion of the related administrative-accounting formalities following the expiry of the right of withdrawal and the terms applied for contesting the payment;
  3. d) data collected in the context of the use of services offered on the Site: these data are kept until the termination of the service or the cancellation of the subscription to the service by the Customer;
  4. e) data related to customer requests to our Customer Service: the data useful to assist you will be kept until your request has been satisfied;
  5. f) data possibly used for commercial communication activities with users who purchase products on the Site (soft spam): these data are kept until the termination of the service or the exercise of the opposition through unsubscription by the user requested to FDM ;
  6. g) any data provided for commercial communications activities, opinion polls and market research: up to the request by the user to interrupt the activity;
  7. h) any data used to personalize the Site and to show personalized commercial offers: until the user requests the cessation of the activity;
  8. i) any data used to carry out market research and surveys to measure satisfaction: until the User requests termination of the activity.

In any case, for technical reasons, the termination of the treatment and the consequent definitive cancellation or irreversible anonymization of the relative personal data will be definitive within thirty days from the terms indicated above.

 

  1. YOUR RIGHTS

a) Access your data and modify them: you have the right to access your personal data and to request that they be corrected, modified or integrated with other information. If you wish, we will provide you with a copy of the data we hold about you.

  1. b) Withdraw your consent: you can withdraw at any time a consent you have given for the processing of your personal data in relation to any activity for marketing purposes. In this regard, we remind you that the sending of commercial and promotional communications, the carrying out of market research and surveys to measure satisfaction with the personalization of the Site and commercial offers based on your interests are considered marketing activities. Upon receipt of your request, we will promptly cease the processing of your personal data that is based on this consent, while different treatments or treatments based on other assumptions will continue to be carried out in full compliance with the provisions in force.
